If they decide to go ahead, the next you would hear is a summons from the court. You could then put forward your views in court and see what the court says. To be honest, as you admit you was holding your notes and looking at them, the court would consider that that is without due care no matter what you say.

When they drive or ride like this way they forget all the things and also loose their common senses. They think that they are competing with the speed, but they don't know actually death is competing with their life in that race...
